Administrative Monetary Penalty System (AMPS)

The Administrative Monetary Penalty System (AMPS) is a municipal alternative to the Provincial Offences Act for adjudicating by-law offences. AMPS transfers by-law adjudications from the provincial courtroom to the municipality.

The Township of Muskoka Lakes passed a by-law to implement an Administrative Monetary Penalty System which applies to by-law offences within the Township of Muskoka lakes. Municipal Law Enforcement Officers can issue an Administrative Penalty Notice against an individual who they believe contravened a Township by-law.

I received an Administrative Penalty Notice (APN), what do I do?

Please ensure to read all information on your APN. You are required to take action within 15 days of receiving your APN.

You have two options:

The administrative penalty amount indicated on the APN is due within 15 days from the date in which it was served. If payment is not received within 15 days of the date in which it was served, a late fee of $25.00 will be added to the penalty amount and the entire amount due will constitute a debt of the person to the Township and the full amount will be added to the tax roll of the applicable person/ property. Payment methods:

  • Cheque or money order only.
  • Please do not send cash in the mail.
  • Please make a cheque or money order payable to the: Township of Muskoka Lakes.
  • Please include the Penalty Notice number on the front of the cheque or money order to ensure it is correctly filed to avoid any further non-payment penalties.
  • Post-dated cheques or payment installments will not be accepted.
  • NSF or returned cheques will be subject to an administrative fee as noted in the Fees and Charges By-law.

 

Should you wish to request a review of the APN, you are required to complete a Request a Review by a Screening Officer within 15 days from the date in which the APN was served.

A separate form is required to be completed for each APN. If you have an agent acting on your behalf, they are required to completed the AMPS Authorization Form.

You have the right to Request a Review by a Screening Officer for the following reasons, and may be required to submit documents:

  • There is a defective form or substance (error) on the APN
  • The APN was not served properly (See FAQ below)
  •  Undue financial hardship (See FAQ below)
  • You have evidence to indicate that the by-law contravention did not occur
  • You believe you took all reasonable steps to prevent the contravention from occurring

Upon review of the APN, a Screening Officer may:

  • Affirm the APN
  • Cancel the APN, reduce the APN amount, and/or extend the time for payment of the APN including any late fees, if the Screening Officer believes it would maintain the general intent and purpose of the by-law and/or any of the above reasons exist.

The Screening Officer will provide a Screening Decision, and unless otherwise decided by the Screening Officer, the APN is due payable no later than 30 days after the Screening Decision.

I am not satisfied with the Screening Decision, what can I do?

You have the right to Request a Review by a Hearing Officer within 30 days of the Screening Decision.

A separate form is required to be completed for each APN.

If you have an agent acting on your behalf, they are required to completed the AMPS Authorization Form

You have the right to Request a Review by a Hearing Officer for the following reasons, and may be required to submit documents:

  • Undue financial hardship (See FAQ below)
  • You have evidence to indicate that the by-law contravention did not occur
  • You believe you took all reasonable steps to prevent the contravention from occurring

Upon review of the APN, a Hearing Officer may:

  • Affirm the Screening Decision
  • Cancel the APN, reduce the APN amount, and/or extend the time for payment of the APN including any late fees, if the Hearing Officer believes it would maintain the general intent and purpose of the by-law and/or any of the above reasons exist.

The Hearing Officer will provide a Hearing Decision, and unless otherwise decided by the Hearing Officer, the APN is due payable no later than 15 days after the Hearing Decision.

Frequently Asked Questions

  • Deemed served immediately if by personal service to the person
  • Deemed served immediately if by affixing it to a vehicle for parking and stopping offences only
  • Deemed served on the 5th day after sent by registered mail or regular mail to the person’s last known address
  • Deemed served immediately after sent by fax or email

A Person claiming financial hardship under this By-law shall provide documented proof of the financial hardship to the Director, the Screening Officer or the Hearing Officer, as applicable.

Documentation to prove financial hardship may include old age security, Canada pension, guaranteed income supplement, disability pension, Ontario student assistance program, or any other form of social assistance.

The Director, Screening Officer, or Hearing Officer will satisfy themselves as to the authenticity/credibility of the documents provided and will consider it in their decision. 

The decision made by the Hearing Officer is final and no further appeal is available, including to another court body.
