Appeal an Order

If an individual is found to be in violation of a Township of Muskoka Lakes by-law, Municipal Law Enforcement Officers have the authority to issue an Order. This Order may require the individual to stop the activity in question and/or take specific actions to correct the violation.

If the recipient of an Order disagrees with its terms or the deadlines provided, they have the right to request an Appeal Hearing before a designated committee.

There are two appeal committees:

    1. Appeal Committee 
    2. Property Standards Appeal Committee

Please note: This process does not apply to Orders issued under the Ontario Building Code or Ontario Fire Code.

Appeal Committee

A person who has been served with an Order, Notice, or Decision under the below listed by-laws and who is not satisfied with the terms or conditions of the Order, Notice, or Decision, may Appeal to the Appeals Committee online through Notice of Appeal within 30 days after being served with the Order.

The Appeals Committee is composed of at least three members of the public. They have the authority to hear appeals of orders or decisions brought before them and have the power to:

  1. Confirm the Order, Notice, or Decision
  2. Modify the Order, Notice, or Decision (remove or modify items)
  3. Extend the time for complying with Order, Notice, or Decision

Please ensure to read all information on your Order.

The fee for an Appeal is $500.00.

If you would like to appeal a Stop Work Order, Order to Remedy, Notice to Muzzle, or License Decision under the above listed by-laws, you are required to submit a Notice of Appeal within 30 days after being served with the Order, Notice, or Decision. Your appeal will be heard by the Appeal Committee.

  • Upon receipt of the Notice of Appeal and the $500 appeal fee, the Appeal Committee Secretary will schedule a Hearing to consider the appeal within sixty (60) days.
  • Once your Hearing has been scheduled, you will receive a Notice of Hearing via email which will include the date and time of the Hearing.
  • The Hearing will be held in-person, but if you wish to attend the Hearing via Zoom you must notify the Appeal Committee Secretary at least three (3) business days prior to the Hearing.
  • The Appeal Committee Agenda will be posted on the Township of Muskoka Lakes website and emailed to you at least seven (7) days prior to the Hearing date. The agenda will include a report from staff with supporting evidence.
  • Please note that there may be other appeal hearings occurring on the same day and time as yours. The agenda will provide the order in which the appeals will be heard.

Property Standards Appeal Committee

Property Standards Orders

A person who has been served with a Property Standards Order and who is not satisfied with the terms or conditions of the Order may Appeal to the Property Standards Committee by sending Notice of Appeal by registered mail to the Secretary of the Property Standards Committee or online through Notice of Appeal within 14 days after being served with the Order.

The Property Standards Committee is composed of at least three members of the public. They have all the powers and functions of the officer who made the Order and they may do any of the following things if, in the committee’s opinion, doing so would maintain the general intent and purpose of the Property Standards By-law and of the Official Plan or policy statement:

  • Confirm, modify or rescind the order
  • Extend the time for complying with the order
